CLAIM: Veterans will still be able to get ratings for tinnitus and sleep apnea even if TCAVA passes and becomes law.
REALITY: According to VA's 2022 Regulatory Impact Analysis, the proposal would eliminate the standalone compensable Diagnostic Code 6260 for tinnitus and VA estimated that nearly 90 percent of future sleep apnea claims would receive a noncompensable (0 percent) evaluation rather than today's 30 or 50 percent evaluations. To claim that veterans will still receive ratings under the new criteria minimizes the dramatic reductions for as many as 1.5 million veterans who will lose up to $57 billion in disability compensation.
